Obituary Submission Agreement

By submitting an obituary to the Prineville Review, a publication of Western Media Group (“Publisher”), the person submitting the obituary (“Submitter”) acknowledges and agrees to the following terms.

1. Authority to Submit

The Submitter represents and warrants that they are authorized to submit the obituary and any accompanying photographs or materials for publication.

The Submitter further represents that they are either a family member, authorized representative of the deceased person’s estate, funeral home representative, or another individual with the appropriate authority or permission to submit the materials.

The Submitter agrees that they are responsible for obtaining any necessary consent or authorization from the deceased person’s estate, legal representative, or other persons with applicable rights or interests.

The Publisher is not responsible for independently verifying the Submitter’s authority and reserves the right to request documentation or confirmation of authorization before or after publication.

2. Accuracy and Responsibility for Submitted Information

The Submitter certifies that, to the best of their knowledge, all information provided is accurate, truthful, and submitted in good faith.

The Submitter is responsible for verifying names, dates, relationships, biographical details, service information, and other submitted content.

The Submitter agrees not to provide knowingly false, defamatory, misleading, unlawful, or otherwise inappropriate material.

The Publisher may request clarification, corrections, or supporting information at its discretion.

3. Editorial Review and Publication

All obituary submissions are subject to editorial review and approval by the Publisher.

Payment and submission do not guarantee publication.

The Publisher reserves the right, at its sole editorial discretion, to:

  • Accept or decline an obituary submission.
  • Edit submitted materials for spelling, grammar, clarity, formatting, length, style, and compliance with publication standards.
  • Request revisions, clarification, or additional documentation.
  • Delay publication while reviewing submitted information or resolving concerns.
  • Decline to publish content that is inaccurate, inappropriate, unlawful, misleading, or otherwise inconsistent with the Publisher’s editorial standards.

The Publisher will make reasonable efforts to preserve the intended meaning and respectful nature of an obituary when making editorial changes.

4. Publication Fees and Payment

The Submitter agrees to pay all applicable fees displayed during the obituary submission process.

Publication fees primarily cover the administrative and editorial work associated with receiving, reviewing, formatting, preparing, and setting up the submitted obituary and accompanying materials as a digital publication or advertisement.

Fees may include charges based on obituary length, photographs, and other selected publication options.

Payment is required as part of the submission process unless otherwise authorized by the Publisher.

5. Refund Policy

All obituary submission and publication fees are nonrefundable, except when the Publisher declines or rejects the submission before its initial publication.

If the Publisher declines or rejects an obituary before it has been initially published, the Submitter will be entitled to a refund of the applicable submission payment.

Once an obituary has been initially published, no refund will be provided, including when the obituary is subsequently corrected, edited, temporarily unpublished, or permanently removed.

Refunds will not ordinarily be provided because of a Submitter’s change of mind, disputes among family members or other interested parties, requests for withdrawal after publication, or dissatisfaction with editorial decisions.

6. Corrections, Removal, and Unpublication

The Publisher reserves the right to correct, modify, temporarily unpublish, or permanently remove any obituary at any time when it determines that such action is appropriate.

Reasons may include, but are not limited to, concerns regarding accuracy, authorization, privacy, legal claims, disputes involving the deceased person’s family or estate, or violations of this Agreement.

Requests for corrections or removal may be submitted to the Publisher for consideration. The Publisher retains final editorial discretion over whether and how such requests are addressed.

Removal or unpublication after initial publication does not entitle the Submitter to a refund.

7. Photographs and Intellectual Property

The Submitter represents that they own or have obtained the necessary rights, licenses, or permissions to submit all photographs, written materials, and other content provided for publication.

By submitting these materials, the Submitter grants Western Media Group a nonexclusive, royalty-free license to reproduce, publish, display, format, edit, distribute, archive, and otherwise use the submitted materials in connection with the obituary and its publication, including on the Publisher’s websites, digital platforms, and related promotional channels.

The Submitter retains any ownership rights they otherwise hold in their original materials.

8. Publication Availability and Archiving

Published obituaries may remain accessible through the Publisher’s website, archives, search engines, and third-party services.

The Publisher does not guarantee perpetual availability, specific search engine placement, continued indexing, or uninterrupted access.

The Publisher is not responsible for copies, cached versions, or archived content maintained independently by third parties.

9. Disputes and Indemnification

The Submitter accepts responsibility for the accuracy, authorization, and lawful submission of all materials provided.

To the extent permitted by applicable law, the Submitter agrees to indemnify and hold harmless Western Media Group, its publications, employees, agents, and representatives against third-party claims, damages, liabilities, and reasonable expenses arising from the Submitter’s breach of this Agreement, unauthorized submission of materials, or infringement of another person’s rights.

This provision does not apply to claims arising solely from the Publisher’s independent misconduct.

10. Limitation of Liability

To the extent permitted by law, Western Media Group shall not be liable for indirect, incidental, consequential, or special damages arising from the submission, editorial review, publication, correction, delay, removal, or unavailability of an obituary.

Nothing in this Agreement excludes or limits liability that cannot lawfully be excluded or limited.

11. Acceptance of Agreement

By submitting an obituary and completing the required acknowledgment during the submission process, the Submitter confirms that they:

  • Have read and agree to this Obituary Submission Agreement.
  • Have the necessary authority or permission to submit the obituary and accompanying materials.
  • Understand that publication is subject to editorial review and approval.
  • Understand and accept the applicable publication fees and refund policy.
